Collection of Personal Information

We may collect and use certain personal information about you, such as your name, contact details, your affiliation with .hk domain names, and other personal information you share with us. We will collect such personal information directly from you (including through the domain name registration, registration form, and your participation in our event, survey or focus group discussion).

Purposes of Collection

The purposes for which the personal information may be used include confirming that you are a holder (or a representative of a holder) of .hk domain, selecting and inviting you to participate in research activities, carrying out market research, developing and improving our products and services, providing you with reward or gift (if any) from participating in the research activities, statistical analysis, and other directly related or ancillary purpose. We may also use your personal information when we need to comply with any applicable law or regulation, or to protect our legitimate interests or the legitimate interests of third parties.

If you do not provide the required personal information, we may not be able to invite you to take part in our event, survey or focus group discussion, and/or provide you with the relevant reward or gift (if any).

Disclosure and Sharing of Personal Information

We will use secured encryption systems as appropriate when collecting personal information over the Internet.

Any personal information we receive will not be disclosed to third parties outside of Hong Kong Domain Name Registration Company Limited except as provided herein or with your prior consent.

We may provide the relevant personal information, whether stored in electronic form or in hard copy form to the following parties on a need-to-know basis:-

  1. Our authorized employees, personnels, agents, auditors, advisers, contractors, service providers or agents, in connection with the purposes stated herein; and
  2. Any person to whom we are required to make disclosure under any law applicable in or outside of Hong Kong.

While we have no control over the acts of any third party, we endeavour to deal only with responsible third parties and would ask them to follow our instructions and specified purposes when using the personal information.

Personal information you provide to us will be retained for such period as may be necessary for the carrying out of the purposes stated herein.

香港，2017年1月18日–香港互聯網註冊管理有限公司（HKIRC）今天宣布，2016年度「最佳 .hk 網站獎」(獎項) 現正接受公眾投票。由即日起至2017年2月8日（中午12時），香港市民可進入大會網站投選他們心目中的「最喜愛.hk網站獎」，並有機會參加抽獎，贏取豐富獎品。獎品包括Lenovo IdeaPad 100S 14 吋筆記型電腦、Ultimate Ears UE Roll藍牙喇叭，以及小米手環2各一份。

今年共接獲476個網站參賽，當中包括262個「商業」網站，71個「非商業」網站，89個「政府部門」網站，以及54個「立法會議員」網站。大會從眾多的參賽網站中選出30強進入公眾投票，分別10個來自「商業組」，8個來自「非商業組」，及12個「政府部門組」網站；而在每個組別獲得最高票數的網站將獲頒「最喜愛.hk網站獎」。

HKIRC行政總裁林廣成先生表示：「今年已是HKIRC連續第8年舉辦『最佳 .hk 網站獎』。自2008年來，我們見證各界在網站發展方面不遺餘力，相關技術水平更不斷提升。『最佳 .hk 網站獎』已演變為一個完善平台，讓參賽機構展示如何透過創新科技，發揮相關專長，並善用數碼科技發展優秀 .hk 網站，引領業界潮流。」

接下來，評審團將會就網站整體設計及操作、互動投入性、善用社交媒體及無障礙網頁共四項評審準則進行最後評審。公眾投票結果將佔總分10%，而評審團的評分則佔總分90%。獲獎公司將獲另行通知，而比賽結果將於2017年4月公布。

由即日起至2016年2月8日，公眾可到www.bestwebsite.hk投選最喜愛的.hk網站，並在每個參賽組別中投選最多3個心儀網站。此活動只接受年滿18歲的香港居民參與，參與者將會自動進入抽獎環節，並有機會贏取獎品。抽獎結果將於2017年3月20日在大會網頁公布，並刊登於星島日報及英文虎報。

It is the policy of Hong Kong Domain Name Registration Company Limited to meet all the requirements of the “Personal Data (Privacy) Ordinance” and endeavour to ensure our compliance with the European Union 2016/679 General Data Protection Regulation (“GDPR”) to the extent it applies. We may collect such personal information from you, from our accredited registrars and resellers. We use such personal information for specific and other directly related purposes. We may also collect personal data for job application, request support or assistance (e.g. email address, phone number, name etc).

Information like your race, political opinion, ethnic origin or religious beliefs, health or sex life information will not be collected.

If you do not provide the required personal information, we may not be able to perform or fully perform our services and the other specified purposes.

In addition to the specific purposes, we may occasionally use such information to send you eNewsletters, promotional and new service updates and invitations to events hosted, sponsored or promoted by us, if you agree. You may choose to opt-out from receiving such materials as well as to select your preference with regard to the receipt of such materials.

We may also use your personal information when we need to comply with any applicable law, regulation, guidance or policy in relation to domain name registration or otherwise, or when we need to protect the legitimate interests of us or third parties (e.g. for domain name dispute purposes).

Important Notice

By using the HKDNR’s Website, you accept and agree to be bound by these Terms of Use unconditionally.

1.

In these Terms of Use, unless the context otherwise requires, the following expression have the following meaning:-

“Confidential Information”

means any information obtained from or through the HKDNR’s Website including but not limited to, data related to applicants and registrants of .hk and/or .香港domain names, whether in writing or otherwise that is not publicly known including any compilation of otherwise public information in a form not publicly known but not including information that, at the time of disclosure, is publicly known; information that, after disclosure, becomes publicly known other than as a result of a breach of this Terms of Use; information that the recipient can show was known to it prior to the disclosure; and information that the recipient can show was made known to it by a third party who was entitled to do so and who did not impose any obligation of confidentiality or restricted use;

By sending requests to us for Domain Name Administration through the HKDNR’s Website, you warrant HKDNR that you are authorised to apply for all the services detailed in your requests or on behalf of your customers, to legally bind you or your customers to the terms and conditions of the documents listed below and that you have acknowledged or have notified your customers that their .hk or .香港 domain name registrations will be bound by such documents, namely:

(i)

the Registration Agreement;

(ii)

the Domain Name Dispute Resolution Policy; and

(iii)

any other applicable agreements, rules, policies, Terms and Conditions and Important Notices.

3.

You shall not, whether by yourself, your agent, employees or any person authorised by you, do any of the following:

a.

use any data obtained from the HKDNR’s Website to send unsolicited commercial advertising of any sort via any medium including but not limited to, the telephone, email or fax; or

b.

enable high volume, automated or electronic processes to access HKDNR’s computer systems including but not limited to, the WHOIS search enquiry service; or

c.

compile, repackage, disseminate, disclose to any third party or use the data obtained from the HKDNR’s Website for any purpose other than obtaining information about a domain name registration record; or

d.

use such data obtained from the HKDNR’s Website to derive an economic benefit for yourself or any third parties except by applying for or maintaining a .hk or .香港domain name for and on behalf of your customers.

4.

You shall treat as confidential at all times all customer data and/or Confidential Information obtained from the HKDNR’s Website and such data shall not be used in any way detrimental to the customer and/or to HKDNR. You shall not divulge the customer data or Confidential Information to any person except to your own employees on a need-to-know basis. You shall prevent any unauthorised use, dissemination or publication of Confidential Information and you shall not do any act, or engage in any practice, that contravenes the Hong Kong Personal Data (Privacy) Ordinance (Cap.486). In the event of any unauthorised disclosure of protected personal data and/or Confidential Information by you, whether willfully or not, you and/or your representatives who disclose the data shall be wholly and personally liable for any losses and/or damages, whether monetary or not, which HKDNR may suffer directly and/or indirectly as a result of such unauthorized disclosure. HKDNR shall be entitled to claim for damages which including but not limited to all legal costs and expenses incurred by HKDNR in connection with the enforcement of these Terms of Use.

HKDNR in its sole discretion may terminate or suspend your ability to access to and/or use of the HKDNR’s Website at any time without prior notice including but not limited to, in the event of (i) a breach of these Terms of Use by you, (ii) non-performance of your obligations under these Terms of Use

DISCLAIMER. HKDNR ACCEPTS NO LIABILITY AND WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING DIRECTLY OR INDIRECTLY (INCLUDING SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE) FROM YOUR ACCESS TO THE HKDNR’S WEBSITE OR USE OF THE HKDNR’S WEBSITE, NOT LIMITED TO BUT INCLUDING ANY LOSS, DAMAGE OR EXPENSE ARISING FROM ANY DEFECT, ERROR, IMPERFECTION OR INACCURACY WITH THE HKDNR.’S WEBSITE, ITS CONTENTS OR ASSOCIATED SERVICES, OR DUE TO ANY UNAVAILABILITY OF ANY PART OF THE HKDNR’S WEBSITE OR ASSOCIATED SERVICES OR TO ANY DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, TROJAN HORSE, WORM, SOFTWARE BOMB, COMMUNICATION LINE FAILURE, SOFTWARE OR HARDWARE DATA (INCLUDING BUT NOT LIMITED TO), OR INTERCEPTION OF ON-LINE COMMUNICATION.

HKDNR MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY REGARDING THE HKDNR’S WEBSITE OR THE MATERIALS AND INFORMATION CONTAINED OR REFERRED TO ON EACH PAGE ASSOCIATED WITH THE HKDNR’S WEBSITE. NO CLAIMS OR ACTIONS OF LEGAL PROCEEDINGS IN CONNECTION WITH THE USE OF THIS HKDNR’S WEBSITE BY YOU OR ANY THIRD PARTIES AUTHORISED BY YOU TO USE THE HKDNR’S WEBSITE WILL BE ENTERTAINED BY HKDNR.

You, your employees, agents and any person authorised by you shall not seek to recover and shall not be entitled to recover from HKDNR or to be indemnified by HKDNR against any direct, indirect or consequential loss or damage suffered by you arising out of or in connection with your use of the HKDNR’s Website.

You shall be held responsible for any losses and damages suffered by HKDNR arising either directly or indirectly from the use of the HKDNR’s Website by you, your employees, agents or any person authorised by you. HKDNR reserves the right to claim and take any actions or legal proceedings for recovery or compensation as a result.

You hereby agree to fully indemnify, defend and hold HKDNR, its affiliates or partners, agents, directors, employees harmless from and against any action, liability, costs claim, loss, damage, proceeding or expense of whatsoever nature (including reasonable legal fees, costs and expenses on a full indemnity basis) arising from or directly or indirectly related to:-

(a)

your access to and/or use of the HKDNR’s Website and/or any other person or entity’s use of this service or the HKDNR’s Website where such person or entity was authorised by you to access and/or use the HKDNR’s Website; or

(b)

any negligent act or omission or breach or non-observance of any of these Terms of Use by you or by any other person or entity where such person or entity authorised by you to use the HKDNR’s Website; or

(c)

any materials you submit, post to, or transmit through the HKDNR’s Website.

All reasonable efforts are made by HKDNR to ensure the information provided on the HKDNR’s Website is accurate and/or up-to-date, HKDNR gives no warranty of any kind express or implied with regard to the accuracy or completeness of any information on the HKDNR’s Website or that the HKDNR’s Website will be error free. Information obtained through the HKDNR’s Website may contain errors including but not limited to, inaccuracies or typographical errors. HKDNR shall not be liable to you for any loss arising out of and to the extent caused by any failure by HKDNR to keep the information on the HKDNR’s Website accurate and/or up-to-date. HKDNR reserves the right in its discretion but undertakes no duty to review, edit or otherwise change without prior warning or notice any information or material contained on the HKDNR’s Website.
